Welcome to Mandrake! By using our conversational AI services, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you may not use our services.

1. Trial and Subscription Billing

Users must provide a valid credit card to activate the trial.

The trial period lasts 3 days days, during which users can cancel without charge.

If the trial is not canceled before it ends, the subscription fee will be automatically charged to the credit card on file. Refunds will not be provided for subscriptions already billed.

2. License and Usage Rights

Mandrake grants you a non-exclusive, non-transferable, revocable license to use our services.

You may not reverse engineer, decompile, or exploit any part of Mandrake’s platform.

The service must not be used for illegal, harmful, or emergency purposes.

3. Service Limitations

Mandrake is provided "as is," with no guarantees of uptime or uninterrupted service.

Mandrake disclaims liability for interruptions or technical issues.

4. Data Collection and Recordings

All conversations, including audio and transcriptions, are recorded to provide and improve Mandrake’s services. These recordings are used internally only.

5. Third-Party Services

Mandrake integrates with third-party services such as Deepgram, Elevenlabs, OpenAI, and Azure.

While we strive to ensure their compliance, we are not liable for their errors or breaches.

6. Fact-Checking and Accuracy

AI-generated responses may contain inaccuracies. Users should fact-check all information provided by Mandrake.

Mandrake is not liable for decisions made based on AI output.

7. User Responsibilities

Users must maintain the confidentiality of their login credentials.

Users are responsible for all activities under their account.

8. Termination

Mandrake reserves the right to suspend or terminate accounts for violations of these Terms or applicable laws.

Upon termination, access to data and recordings may be restricted.

9. Liability Limitation

Mandrake is not liable for any damages, including indirect, incidental, or consequential damages, arising from the use or inability to use the services.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Delaware.

11. Changes to Terms

Mandrake reserves the right to modify these Terms. Users will be notified of significant changes via phone.

12. Force Majeures

Mandrake is not responsible for delays or failures caused by events beyond our control, such as natural disasters, cyberattacks, or technical outages.
